Thornham Marina
Southern Planning Practice assisted Thornham Marina and achieved success at appeal following enforcement action by Chichester District Council over the construction of a set of Ark 900 boats, which are marketed as ‘innovative floating retreats’. The substantial evidence brought to appeal meant that the floating pod-style dwellinghouses did not fall under section 336(1)’s definition of building operations. However, it is not always so clear cut. A detailed analysis of the three criteria of size, permanence, and physical attachment weighed in favour of these unique vessels being boats and ‘not buildings’ on this occasion. This case demonstrates the need for clarity and robust evidence to support your case for enforcement appeals.
